DG Comp’s Discussion Paper on Article 82: Implications of the Proposed Framework and Antitrust Rules for Dynamically Competitive Industries

Here's a link to a paper co-authored with Christian Ahlborn, Vincenzo Denicolò and Jorge Padilla, which we have submitted in the framework of the public consultation process on the Commission's discussion paper on Article 82 EC

My co-authors and I believe that, while the discussion paper makes progress on several fronts, it contains extremely worrying language with respect to a number of issues, such as refusal to supply and compulsory licensing. Moreover, the Commission paper seems poorly adapted to the specific fatures of dynamically competitive industries.
